Defendant having moved pursuant to CPL 460.30 to extend the time to take an appeal from a judgment of Onondaga County Court, rendered August 4, 2017,

Now, upon reading and filing the affirmation of I. Aurora Flores, Esq. dated

February 16, 2018, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is dismissed as unnecessary.

Memorandum: Pursuant to the orders of this Court entered November 29, 2017 and December 11, 2017, defendant timely filed a pro se notice of appeal dated December 5, 2017 in the Onondaga County Clerk's office on December 12, 2017, and timely served the Onondaga County District Attorney's Office on December 5, 2017.
