Oct 28, 2008
55 A.D.3d 924 (N.Y. App. Div. 2008)

Opinion

No. 2007-08173.

October 28, 2008.

Appeal by the defendant from a judgment of the County Court, Suffolk County (Braslow, J.), rendered July 30, 2007, convicting him of aggravated unlicensed operation of a motor vehicle in the first degree (two counts) and criminal possession of stolen property in the fifth degree, upon his plea of guilty, and imposing sentence.

Robert C. Mitchell, Riverhead, N.Y. (Alfred J. Cicale of counsel), for appellant.

Thomas J. Spota, District Attorney, Riverhead, N.Y. (Steven A. Hovani of counsel), for respondent.

Before: Fisher, J.P., Lifson, Covello and Balkin, JJ.

Ordered that the judgment is affirmed.

We have reviewed the record and agree with the defendant's assigned counsel that there are no nonfrivolous issues which could be raised on appeal. Counsel's application for leave to withdraw as counsel is granted ( see Anders v California, 386 US 738; People v Paige, 54 AD2d 631; cf. People v Gonzalez, 47 NY2d 606).
