Appellant having moved for permission to proceed as a poor person on the appeal taken from a judgment of the Monroe County Court, rendered April 9, 2013,

Now, upon reading and filing the affirmation of Brian Shiffrin, Esq. dated April 19, 2013, the notice of motion with proof of due service thereof, the undated statement of Donald Englert, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is denied with leave to renew upon the filing and serving of an application containing a sworn affidavit from the defendant establishing proof of indigency.
