On order of the Court, the application for leave to appeal the February 3, 2014 order of the Court of Appeals is considered, and it is DENIED, because the defendant has failed to meet the burden of establishing entitlement to relief under MCR 6.508(D). With regard to Issue II raised in the defendant's application for leave to appeal, the Wayne Circuit Court record currently includes five trial transcripts, as well as other transcripts and documents. This order does not prohibit the defendant from requesting documents and transcripts from the Wayne Circuit Court pursuant to MCR 6.433(C).
