An appeal having been taken to this Court from a judgment of the Supreme Court, New York County, rendered on or about January 8, 2018, and a Certificate having been issued by a Justice of this Court on September 25, 2019 (M-2165) granting defendant leave to appeal from orders, same Court, entered on or about December 21, 2016 and January 9, 2018,
And an order of this Court having been entered on April 16, 2020 (M-669) relieving The Legal Aid Society, and substituting Christina Swarns, Esq., predecessor counsel to Caprice R. Jenerson, Esq., Office of the Appellate Defender, as assigned counsel, and continuing the poor person relief previously granted by this Court's order entered November 20, 2018 (M-4604), and a motion having been made by assigned counsel Caprice R. Jenerson, Esq., Office of the Appellate Defender, to be relieved as such counsel,
Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,
It is ordered that the motion is granted to the extent of striking the designation of Caprice R. Jenerson, Esq., Office of the Appellate Defender, as assigned counsel, and substituting, pursuant to Section 722 of the County Law, Richard L. Herzfeld, Esq., 112 Madison Avenue, 8th Floor, New York, New York 10016, Telephone (212) 818-9019, as such counsel. The poor person relief previously granted is continued, and appellant's time in which to perfect the appeals is enlarged until 120 days from the date of this order or of the receipt of the complete record, whichever is later.
