An order of this Court having been entered on October 17, 2017 (M-5022), assigning Seymour W. James, Esq., predecessor counsel to Justine M. Luongo, Esq., The Legal Aid Society, as counsel to prosecute defendant's appeal taken from the judgment of the Supreme Court, New York County, rendered on or about February 14, 2017,And assigned counsel Justine M. Luongo, Esq., The Legal Aid Society, having moved for an order dismissing the appeal without prejudice to reinstatement as such time as the defendant-appellant becomes amenable to the jurisdiction of this Court, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is granted to the extent of deeming the appeal withdrawn.
