Defendant having moved pursuant to CPL 460.10(6) to amend the notice of appeal filed in the Office of the Clerk of the County of Niagara on July 20, 2011,

Now, upon reading and filing the affidavit of Michelle G. Bergevin, Esq. sworn to August 22, 2011, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted to the extent that said notice of appeal shall be treated as valid as to the judgment rendered under indictment number 2011-005.
