THE PEOPLE OF THE STATE OF NEW YORK, RESPONDENT, v. JOSEPH DIXON, DEFENDANT-APPELLANT.


PRESENT:

Counsel for appellant having moved for reassignment of counsel to prosecute the appeal taken from a judgment of the Steuben County Court, rendered March 24, 2014,

Now, upon reading and filing the affidavit of Joseph E. Dixon sworn to April 13, 2016, the notices of motion with proof of service thereof, the affidavit of Brenda Aston, Esq. sworn to April 20, 2016, and due deliberation having been had thereon,

It is hereby ORDERED that the motion filed by appellate counsel is granted, and Brenda S. Aston, Esq. is relieved of her assignment, and

It is further ORDERED that John A. Cirando, Esq., 101 South Salina Street, Suite 1010, Syracuse, New York 13202-1350, is substituted as counsel to conduct the above-entitled appeal taken from the judgment of the Steuben County Court, rendered March 24, 2014, in place of Brenda S. Aston, Esq., and the appeal may be prosecuted upon one record as defined by 22 NYCRR 1000.3 (c)(1) and ten copies of appellant's briefs reproduced pursuant to CPLR 5529, and

It is further ORDERED that the Clerk of Steuben County is directed to provide John A. Cirando, Esq. with copies of all papers and transcripts of stenographic, digitally recorded, or audiotaped minutes, if any, of the proceedings upon which the appeal is based, and

It is further ORDERED that the ordering paragraph of the order of this Court entered April 4, 2016 is hereby amended by striking therefrom the date June 3, 2016 and inserting in place thereof the date October 3, 2016, and

It is further ORDERED that the motion filed by appellant pro se is dismissed as unnecessary.
