It is ordered that the opinion filed herein on February 4, 2008, be modified as follows:

1. On page 1, the second full paragraph, the first sentence under "FACTS" is deleted and the following sentence is inserted in its place:

Police Officer Allen Macias, while driving near a bus stop, saw Diaz.

There is no change in the judgment.

Appellant's petition for rehearing is denied.
