Defendant having moved pursuant to CPL 460.30 to extend the time to take an appeal from an adjudication of the Supreme Court, Onondaga County, rendered February 23, 2015,
Now, upon reading and filing the affidavit of Dennis Rice sworn to October 5, 2015, the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted to the extent that the notice of appeal dated April 30, 2015 which was filed at the Onondaga County Clerk's Office and served upon the Onondaga County District Attorney's Office on April 30, 2015 is hereby deemed timely filed and served.
