People v. Dennis

Appellate Division of the Supreme Court of New York, Second Department
Mar 13, 1995
213 A.D.2d 491 (N.Y. App. Div. 1995)

Opinion

March 13, 1995

Appeal from the Supreme Court, Kings County (George, J.).

Ordered that the judgment is affirmed.

The defendant's contention that the evidence was legally insufficient to establish that the stolen vehicle that the defendant was convicted of possessing was worth more than $100 is unpreserved for appellate review (see, CPL 470.05; People v. Udzinski, 146 A.D.2d 245). In any event, viewing the evidence adduced at the trial in the light most favorable to the People (see, People v. Contes, 60 N.Y.2d 620), we find that it was legally sufficient to establish the defendant's guilt beyond a reasonable doubt.

We have reviewed the defendant's remaining contentions and find them to be without merit. Sullivan, J.P., Balletta, Rosenblatt and Miller, JJ., concur.
