Defendant having moved for a determination of a motion to proceed as a poor person and assignment of counsel on the appeal taken from an order of the Onondaga County Court, dated June 23, 2014,

Now, upon reading and filing the affidavit of Dominic Dennard sworn to February 2, 2016, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is dismissed as unnecessary.
