Defendant having moved pursuant to CPL 460.30 to extend the time to take an appeal from a judgment of Allegany County Court, rendered September 30, 2013,

Now, upon reading and filing the affidavit of John C. Nelson, Esq. sworn to August 21, 2014, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted to the extent that the notice of appeal served upon the Allegany County District Attorney's Office on June 5, 2014 and filed at the Allegany County Clerk's Office on June 20, 2014 is hereby deemed timely served and filed.
