On order of the Court, the motion for immediate consideration is GRANTED. The delayed application for leave to appeal from the July 28, 1999, decision of the Court of Appeals is considered, and it is DENIED, without prejudice to the defendant raising his claims of ineffective assistance of counsel and trial court instructional error by motion for relief from judgment under MCR 6.508 and seeking appointment of counsel based on his current financial situation.

Cavanagh and Kelly, JJ., would remand to the Court of Appeals as on leave granted and for appointment of counsel.
