THE PEOPLE OF THE STATE OF NEW YORK, RESPONDENT, v. TIMOTHY DEAN, DEFENDANT-APPELLANT.


PRESENT:

Appellant having moved to withdraw the brief filed on the appeal from a judgment of the Wayne County Court, rendered July 25, 2019, and respondent having moved for an extension of time to file and serve a brief, and to remove the appeal from the Court's April calendar,

Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,

It is hereby ORDERED that the motions are granted.

MEMORANDUM: The appellant's brief is deemed withdrawn, the appeal is removed from the calendar, and upon the re-filing of the appellant's record and brief, a new scheduling order will be issued.
