Appellant having moved for an extension of time to perfect the appeal taken from the judgment of Ontario County Court rendered March 29, 2011, and for other relief,

Now, upon reading and filing the affirmation of David M. Abbatory, Jr., Esq. dated January 25, 2012, the notice of motion with proof of service thereof, the statement of R. Michael Tantillo, Esq. dated February 2, 2012, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted to the extent that appellant perfect the appeal on or before May 22, 2012, and in the event of failure to so perfect, the appeal is hereby dismissed without further order, and

It is further ORDERED that the motion is otherwise denied without prejudice.
