Motion for an extension of time within which to make application for leave to appeal pursuant to CPL 460.20 denied upon the ground that an application has been made to and denied by a Justice of the Appellate Division (see People v McCarthy, 250 N.Y. 358, 361-362; Cohen and Karger, Powers of the New York Court of Appeals, § 191, pp 718-719), without prejudice to defendant's motion, if he be so advised, for reargument in the Appellate Division.
