THE COURT

IT IS ORDERED that the opinion filed herein on June 12, 2014, 226 Cal.App.4th 1353; __ Cal.Rptr.3d __ be modified in the following particulars and the petition for rehearing is DENIED: '

In the first full paragraph on page 2, after the sentence beginning “We denied Davis’s motion to consolidate" [226 Cal.App.4th 1359, advance report, 2d par., line 3], the following sentence is added: “Accordingly, this court takes judicial notice of the record in the related writ proceeding (A139767). (Evid. Code §§ 452, 459.)”

This modification does not effect a change in the judgment.

Appellant’s petition for rehearing is denied.
