Defendant having moved pursuant to CPL 460.30 to extend the time to take an appeal from a judgment of the Jefferson County Court, rendered February 19, 2016,
Now, upon reading and filing the affidavit of Corey Daniels sworn to September 20, 2016, the notice of motion with proof of service thereof, the affidavit of Harmony A. Healy, Esq. sworn to October 21, 2016, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted to the extent that the pro se notice of appeal dated February 8, 2016, which was served upon the Jefferson County District Attorney's Office on June 8, 2016, is hereby deemed timely served, and
It is further ORDERED that the pro se notice of appeal dated February 8, 2016 shall be treated as valid as to the judgment of Jefferson County Court rendered February 19, 2016 for Indictment number 15-213-15 pursuant to CPL 460.10 (6).
