DECISION & ORDER ON MOTION

Motion by appellant on an appeal from judgments of conviction of the Criminal Court of the City of New York, Queens County, rendered July 19, 2017, for leave to serve and file a supplemental brief.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that appellant's motion is granted and appellant is granted leave to serve and file a supplemental brief within 21 days of the date of this decision and order on motion solely to address the impact of People v Wheeler (34 NY3d 1134 [2020]), if any, on the instant appeal. Respondent may serve and file a supplemental respondent's brief, limited to the same subject matter, within 14 days after the service upon them of appellant's supplemental brief.
