DECISION AND ORDER ON MOTION

Motion, pursuant to CPL 460.30, for extension of time to move for permission to appeal.

Application for permission to appeal.

Motion for permission to proceed as a poor person and for assignment of counsel.

Upon the papers filed in support of the motions and the application and the papers filed in response thereto, it is

ORDERED that the motion for an extension of time to move for permission to appeal is denied, as unnecessary, and it is further

ORDERED that the application for permission to appeal is referred to Justice Egan, who makes the following decision: Application denied. It is further

ORDERED that the application for permission to proceed as a poor person and for assignment of counsel is denied.
