An order of this Court having been entered on February 18, 2020 (M-8594), inter alia, granting defendant's motion for leave to prosecute, as a poor person, the appeal taken to this Court from a judgment of the Supreme Court, Bronx County, rendered on or about June 26, 2019, under SCI. No. 1012/19, and assigning counsel therefor, And defendant-appellant having moved for an order amending the notice of appeal and the aforementioned order to include his appeal to the Appellate Term, First Department from a separate judgment of the same Court, same date, under Docket No. 2019BX007291, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, and on the Court's own motion,
It is ordered that the aforesaid appeal from the Appellate Term, First Department, is hereby transferred to the Appellate Division, First Department, pursuant to Constitution Article VI § 4(i), for hearing and determination, and consolidated with the appeal taken under SCI No. 1012/19, and
It is further ordered that said motion is also granted to the extent of extending the poor person relief and assignment of counsel previously granted under SCI. No. 1012/19 to cover the appeal taken under Docket No. 2019BX007291.
All further proceedings in connection with the appeal shall be conducted pursuant to the rules of the Appellate Division, First Department.
