On order of the Court, the motion for immediate consideration is considered, and it is GRANTED. The motion for reconsideration of this Court's order of March 25, 2002 is considered, and it is GRANTED. On reconsideration, we amend our order dated March 25, 2002 as follows:
On order of the Court, the motion for immediate consideration is GRANTED. The motion for peremptory reversal is considered, and it is DENIED. The application for leave to appeal from the December 3, 2001 decision of the Court of Appeals is also considered and, it appearing to this Court that the case of People v Petit (Docket No. 119348) is pending on appeal before the Court and that the decision in that case may resolve an issue raised in the present application for leave to appeal, we ORDER that the application be held in ABEYANCE pending the decision in that case. In all other respects, the application for leave to appeal is DENIED, because we are not persuaded that the questions presented should be reviewed by this Court.
Kelly, J., would grant reconsideration and, on reconsideration, would deny leave to appeal.
