Appellant having moved to consolidate the appeal taken from a judgment of Supreme Court, Erie County rendered June 10, 2010 (KA 10-01366), with an appeal from an order of Supreme Court, Erie County dated December 23, 2013,

Now, upon reading and filing the affidavit of Maurice Cotton, sworn to January 16, 2014, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is denied.

Memorandum: Appellate review of an order denying a CPL 440.10 motion is authorized by permission of an intermediate appellate court pursuant to CPL 450.15(1) and 460.15.
