People v. Cosolino

Appellate Division of the Supreme Court of New York, Second Department
Feb 1, 1917
177 App. Div. 899 (N.Y. App. Div. 1917)

Opinion

February, 1917.

Judgment of conviction of the Court of Special Sessions reversed and a new trial ordered, upon the ground that the vial produced in court had not been sufficiently identified and connected with defendant; that, therefore, the evidence failed to establish the defendant's guilt beyond a reasonable doubt. Jenks, P.J., Thomas, Stapleton, Rich and Putnam, JJ., concurred.
