OPINION

THE COURT

Appellant Robert Correll was charged with identity theft (Pen. Code, § 530.5, subd. (a); count 1), a felony, and possession or control of child pornography (Pen. Code, § 311.11; count 2), a misdemeanor. Appellant pled guilty on count 1 and was convicted on count 2 following a court trial. The court suspended imposition of sentence for five years, placed appellant on probation and, as a condition of probation, ordered that appellant serve nine months in county jail for the count 2 offense.

Appellants appointed appellate counsel has filed an opening brief which summarizes the pertinent facts, with citations to the record, raises no issues, and asks that this court independently review the record. (People v. Wende (1979) 25 Cal.3d 436.) Appellant has not responded to this courts invitation to submit additional briefing.

Following independent review of the record, we have concluded that no reasonably arguable legal or factual issues exist.

The judgment is affirmed.
