MOTION DECISION

PRESENT: Hon. Barbara R. Kapnick, Ellen Gesmer Tanya R. Kennedy Saliann Scarpulla Julio Rodriguez III, Justice Presiding, Justices.

An appeal having been taken to this Court from a judgment of the Supreme Court, New York County, rendered on or about October 29, 2021,

And defendant-appellant having moved for an order enlarging the record on appeal to include the transcript of the grand jury proceedings, including grand jury minutes that were previously disclosed, and directing The People to provide assigned appellate counsel with transcripts of the grand jury instructions, or, in the alternative, to submit the transcripts to this Court for in camera review, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is granted to the extent of deeming the record on appeal to include the complete grand jury minutes, and directing respondent to provide to assigned counsel for defendant-appellant a copy of the transcripts of the prosecutor's instructions to the grand jury.
