On order of the Court, the delayed application for leave to appeal from the October 15, 2002 decision of the Court of Appeals is considered, and it is DENIED, because we are not persuaded that the questions presented should be reviewed by this Court.

Kelly, J., would hold this case in abeyance for People v Aliakbar, lv gtd 467 Mich. 871 (2002), and People v Babcock, lv gtd 467 Mich. 872 (2002).
