Ordered that defendant-appellant's motion is denied without prejudice to defendant-appellant renewing this motion and submitting an affidavit advising whether he had private counsel at his plea and sentencing, and if so, disclosing the terms of his retainer with private counsel, including the amount and source of funds that he used to retain private counsel, explaining why such funds are not longer available to defendant to prosecute this appeal, and explaining why his monthly income after expenses of $800 is not available to retain an attorney to prosecute this appeal.
