Appellant having moved for permission to proceed as a poor person on the appeal taken herein from a judgment of the Ontario County Court, rendered January 6, 2009,

Now, upon reading and filing the affirmation of Frank Howard, Esq. dated September 28, 2015, the statements of Frank J. Howard, Esq. dated September 3, 2015 and October 23, 2015, the affidavit of Christopher Cooley sworn to August 25, 2015, the statement of Christopher J.
