Opinion

No. 124156.

September 26, 2003.

Summary Disposition.

No. 124156. In lieu of granting leave to appeal, the case is remanded to the Court of Appeals for consideration, as on leave granted, of the question whether the holding in People v. Pearson, 404 Mich 698 (1979), that a postjudgment evidentiary hearing is required when a prosecutor fails to produce an endorsed res gestae witness, remains good law in light of the Legislature's amendment of MCL 767.40a. MCR 7.302(G)(1). Court of Appeals No. 246640.

CAVANAGH and KELLY, JJ. We would deny leave to appeal.
