Summary Dispositions October 27, 1998.

In lieu of granting leave to appeal, the Judgment of the Wayne Circuit Court is reversed, and the matter is remanded to that Court for further proceedings. MCR 7.302(F)(1). The circuit court abused its discretion in quashing the count of assault with intent to rob while armed. There was sufficient evidence presented at the preliminary examination to support the district court's finding of probable cause. Jurisdiction is not retained.

Court of Appeals No. 209811.


I would deny leave to appeal as I find no abuse of discretion on the part of the trial judge.
