ORDER MODIFYING OPINION [No Change In Judgment]

IT IS ORDERED that the opinion filed in the above-captioned matter on November 19, 2008, be modified as follows.

In part 4 of the Discussion section, second paragraph, the following is deleted: “(See People v. King (2007 156 Cal.App.4th 1526, 1528, 1533 [where defendant killed victim in the course of a robbery, and there was no evidence the killing was either intended to or did accomplish any goal other than to facilitate the planned robbery, there was no basis for separate punishments for murder and robbery; inference from evidence was that perpetrators “wished only to immobilize [the victim], so as to facilitate their robbery and ensure their getaway”].)”

There is no change in judgment.
