Now, upon reading and filing the affirmation of Geoffrey Kaeuper, Esq. dated November 7, 2012, the notice of motion with proof of service thereof, due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted, and appellant is directed to perfect the appeal pursuant to 22 NYCRR 1000.7 on or before December 26, 2012, and
It is further ORDERED that respondent file and serve a brief pursuant to 22 NYCRR 1000.7 on or before January 25, 2013, and
It is further ORDERED that any reply brief be filed and served on or before February 11, 2013, and
It is further ORDERED that the appeal be placed on the term of this Court commencing on February 19, 2013.
