An order of this Court having been entered on March 7, 2017 (M-43) granting defendant leave to prosecute, as a poor person, the appeal taken to this Court from an order of the Supreme Court, New York County (Jackson, J.), entered on or about November 29, 2016, and assigning Seymour W. James, Jr., Esq., predecessor to Justine M. Luongo, Esq., The Legal Aid Society, as counsel to prosecute the appeal, And assigned counsel having moved for an extension of time in which to perfect the appeal, or in the alternative, to deem the appeal timely perfected, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is granted to the extent of extending the time in which to perfect the appeal to the October 2022 Term of this Court.
