Appellant having moved to vacate the dismissal of the appeal taken from an order of the Steuben County Court, dated December 15, 2015, and for other relief,
Now, upon reading and filing the affirmation of Mary P. Davison, Esq. dated December 13, 2016, the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted, on the condition that the appeal is perfected on or before March 28, 2017, and
It is further ORDERED that the appeal herein may be prosecuted upon one record as defined by 22 NYCRR 1000.3 (c) (2) and ten copies of appellant's brief, reproduced pursuant to CPLR 5529, and
It is further ORDERED that the Steuben County Assigned Counsel Administrator is directed to provide this Court with an attorney who is willing and able to accept an assignment to conduct the appeal.
