In a "Letter of Modification" filed on May 23, 2007, attorney Cindi B. Mishkin has represented to us that "Appellant requests a grammatical modification of the opinion to reflect that appellant is a female."

Based on this request, the opinion filed in this matter on May 8, 2007, is hereby modified, as follows:

1. The first full sentence in the last paragraph on page two is modified to read: "Defendant appealed, and upon her request this court appointed counsel to represent her."

2. The first full paragraph on page three is modified to read: "We offered defendant an opportunity to file a personal supplemental brief, which she has not done."

These modifications do not change the judgment.
