ORDER MODIFYING OPINION
(NO CHANGE IN JUDGMENT)
THE COURT:
It is ordered that the opinion filed herein on December 30, 2008 be modified as follows:
1. The third full sentence under subheading 2(a) on page 3, beginning with, "Segundo again got a close look" and ending with "Segundo and his friend," is modified so that the sentence now reads:
Segundo again recognized Coleman after the chase when Drips pointed his gun at Coleman and his friend.
2. The first full sentence under subheading 2(b) on page 3 is modified by replacing the word "to" with the word "toward," so that the sentence now reads:
Jesse Robles was at the barbecue in his familys backyard when he heard two shots and raced toward the street.
3. The second full sentence under subheading 2(c) on page 4 is modified by replacing the first use of the word "to" with the word "toward," so that the sentence now reads:
He ran after Jesse Robles toward the street, arriving in time to see the white van drive by.
4. The last full sentence under subheading 2(c) on page 4 is modified to replace the words "the day" with the word "soon" and to replace the word "shooter" with the word "driver." The sentence now reads:
Lopez was contacted by sheriffs deputies soon after the shooting and identified Coleman as the driver.
There is no change in the judgment.
