People v. Cole

Supreme Court of Michigan
May 7, 1999
595 N.W.2d 823 (Mich. 1999)

Opinion

No. 114527.

May 7, 1999.

On order of the Court, the motion for immediate consideration, the motion for stay of proceedings, and the delayed application for leave to appeal from the March 25, 1999 decision of the Court of Appeals are considered and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we GRANT immediate consideration and STAY proceedings pending review by the Court of Appeals as described in this order. We REMAND the case to the Court of Appeals for further consideration of the prosecution's request for appellate relief. We DIRECT the Court of Appeals to order the court reporter to promptly prepare a transcript of all of the proceedings on the motion to suppress, including the trial judge's ruling, or to appear before that court to explain why the reporter should not be held in contempt of that court. We leave to the discretion of that court whether to receive additional briefing in the event that any party requests it.

We do not retain jurisdiction.
