Supplemental briefing ordered
Pursuant to California Rules of Court, rule 8.520(e), the parties are directed to serve and file supplemental briefs on the following issue: What is the effect, if any, of the recent amendment to Penal Code section 745, subdivision (b) on the issues in this case? (Stats. 2023, ch. 464, § 1.)
Appellant's supplemental opening brief limited to this question is to be served and filed on or before December 27, 2023. Respondent's supplemental brief shall be served and filed within 20 days after the filing of appellant's supplemental brief. Appellant's supplemental reply brief, if any, shall be served and filed within two weeks after the filing of respondent's brief.
If the briefing contemplated by this order remains incomplete after the date of oral argument, absent further order of this court, the matter will be submitted on the date that the last supplemental brief is or could be timely filed. (Cal. Rules of Court, rule 8.524(h)(1).)
