Appellant Jemail Ali Clinton appeals from the judgment following his plea of no contest to a charge of assault with a deadly weapon. The court sentenced appellant to four years in prison. His appointed counsel filed a brief pursuant to People v. Wende (1979) 25 Cal. 436 (Wende), raising no issues. Appellant was notified on October 6, 2011, that he could file his own brief and to date has not done so.

STATEMENT OF FACTS

On the morning of November 2, 2010, Delilah Clinton (Delilah) was at her home when appellant, her husband, who was no longer living there and whom she was divorcing, arrived there to pick up a PlayStation. Because the PlayStation belonged to her son she refused to give it him. Appellant pushed past Delilah and entered her home. He started fighting with Delilah's boyfriend (Hill) who fought back and managed to get appellant out of the house. The police were called, they came, took a report and left.

After the police left, appellant returned and hit Hill on the back of his neck with a baseball bat. At the time, Hill was helping to get Delilah's children in the car so they could be driven to court. Hill was taken to the hospital by ambulance and treated for his injuries.

DISCUSSION

Having reviewed the entire record, we are satisfied that counsel has fully complied with her responsibilities under Wende and no arguable issues exist.

DISPOSITION

The judgment is affirmed.
