I would remand for a Ginther hearing.

People v Ginther, 390 Mich. 436 (1973).

Under the circumstance that a codefendant was acquitted by a different jury that heard the same accusations by the complainant at the joint trial of the defendant and the codefendant, this Court should remand for a Ginther hearing to carefully explore the defendant's claims of ineffective assistance of counsel, which the Court of Appeals addressed at some length without a Ginther hearing.
