PEOPLE v. CISNEROS (LEONARDO ALBERTO)

Appellant's “Motion to Preclude Filing of the Appellate Record,” filed on March 6, 2020, is granted in part and denied in part as follows. The superior court's certification of the record on appeal for accuracy is vacated and the matter of certification of the record is remanded to the superior court for further proceedings. The superior court is directed to conduct whatever proceedings are necessary to produce and certify as accurate any supplemental clerk's and reporter's transcripts regarding the proceedings of appellant's codefendants that occurred up to and including that codefendant's entry of a plea of guilty. In addition, the superior court is directed to produce and certify the transcripts it ordered to be made part of the record on appeal, but which have not been included in the record transmitted to this court: The reporter's transcripts of (1) the October 28, 2009 hearing regarding codefendants Resendez and Oso, and (2) the December 18, 2009 hearing regarding codefendant Lopez. The certification for accuracy and transmittal to this court and the parties of any supplemental clerk's and reporter's transcripts is due September 21, 2020.

In all other respects, appellant's motion is denied.
