By order of December 15, 1997, the plaintiff's application for leave to appeal as cross-appellant from the August 23, 1996 decision of the Court of Appeals was granted and the defendant's application for leave to appeal was held in abeyance pending the decision of this Court in that portion of the case. On order of the Court, the decision having been issued on December 28, 1998, 459 Mich. 216 (1998), the application for leave to appeal is again considered, and it is DENIED, because we are not persuaded that the questions presented should reviewed by this Court.
