ORDER MODIFYING OPINION

THE COURT:

It is ordered that the opinion filed herein on January 18, 2011 be modified as follows:

On page 10, the second full sentence, beginning with “Accordingly, ” is changed to read:

Accordingly, we modify Chavez’s sentence to impose two years (the middle term) for the hate-crime enhancement in count 3, eight months (one-third the middle term) for the hate crime enhancement in count 4 and three years (the upper term) for count 1 pursuant to section 422.75, subdivision (a), to comport with the jury’s findings and the trial court’s clear intent in sentencing Chavez under those counts.

There is no change in judgment.
