MOTION DECISION

DECISION AND ORDER ON MOTION

Motion, pursuant to CPL 460.30, for extension of time to move for permission to appeal to this Court and, pursuant to CPL 460.15, for permission to appeal to this Court from order of County Court, Otsego County, dated April 26, 2023.

Upon the papers filed in support of the motion, and no papers having been filed in opposition thereto, it is

ORDERED that the motion for an extension of time to move for permission to appeal to this Court is denied as unnecessary, and it is further

ORDERED that the motion for permission to appeal to this Court is referred to Justice Reynolds Fitzgerald, who makes the following decision: Motion granted, and it is certified that the case involves questions of law or fact which ought to be reviewed by this Court, and it is further

ORDERED that the appeal shall be heard together with the appeal from the judgment of conviction.
