People v. Charles

Appellate Division of the Supreme Court of New York, Second Department
Oct 14, 1997
243 A.D.2d 310 (N.Y. App. Div. 1997)

Opinion

October 14, 1997

Appeal from the Supreme Court, Bronx County (Steven Barrett, J.).

We see no reason to remand for further sentencing proceedings. The allegedly inaccurate information in the presentence report concerned "the circumstances attending the commission of the offense" (CPL 390.30), and was within the proper scope of the presentence investigation.

Concur — Milonas, J.P., Wallach, Williams, Tom and Mazzarelli, JJ.
