THE COURT:

It is ordered that the opinion filed herein on March 30, 2010, be modified as follows:

The last two sentences in footnote 2 on page 8 are deleted. As so modified, this footnote now reads: The court ruled that, if defendant testified, he could be impeached with his 1995 robbery conviction.

There is no change in the judgment.

The petition for rehearing is denied.
