Appellate Division of the Supreme Court of New York, Second Department
Mar 16, 2010
71 A.D.3d 908 (N.Y. App. Div. 2010)

Opinion

No. 2007-02109.

March 16, 2010.

Appeal by the defendant from a judgment of the County Court, Nassau County (Sullivan, J.), rendered February 16, 2007, convicting him of murder in the second degree, upon his plea of guilty, and imposing sentence.

Patrick Michael Megaro, Hempstead, N.Y., for appellant.

Kathleen M. Rice, District Attorney, Mineola, N.Y. (Andrew Fukuda of counsel; Matthew C. Frankel on the brief), for respondent.

Before: Fisher, J.P., Santucci, Eng and Chambers, JJ., concur.

Ordered that the judgment is affirmed.

We have reviewed the record and agree with the defendant's assigned counsel that there are no nonfrivolous issues which could be raised on appeal. Counsel's application for leave to withdraw as counsel is granted ( see Anders v California, 386 US 738; People v Paige, 54 AD2d 631; cf. People v Gonzalez, 47 NY2d 606).
