Opinion

March 3, 1980

Appeal by defendant from a judgment of the County Court, Westchester County, rendered January 31, 1978, convicting him, inter alia, of attempted murder of a peace officer, upon a jury verdict, and imposing sentence. Judgment affirmed. Considering the charge as a whole, the court did not shift the burden of proof on the issue of intent. In any event, the proof of guilt was overwhelming. Mollen, P.J., Hopkins, Titone and Weinstein, JJ., concur.
